Terms of Service

These Terms of Service ("Terms") govern your access to and use of Apus AI, including our website at v1.songgram.uz, APIs, dashboards, and related services (collectively, the "Service"), operated by Apus AI ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service.

Apus AI is an AI-powered social media automation platform that helps creators, businesses, and agencies manage engagement across supported platforms including Instagram, Telegram, and TikTok. Features may include automated direct message replies, comment responses, chatbot workflows, analytics, gamification tools, and third-party account integrations.

We may modify, suspend, or discontinue any part of the Service at any time. We do not guarantee uninterrupted availability or compatibility with every feature of third-party platforms.

You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You agree to provide accurate registration information and to keep it up to date. Notify us immediately at support@socialbot.io if you suspect unauthorized access to your account.

To use certain features, you must connect one or more third-party social media accounts. By connecting an account, you authorize Apus AI to access and act on that account through official APIs according to the permissions you grant.

You represent that you own or have the legal right to manage each connected account. You are solely responsible for compliance with each platform's terms of service, community guidelines, API policies, and rate limits — including Meta/Instagram, Telegram, TikTok, and others.

We are not affiliated with, endorsed by, or sponsored by Meta, Instagram, Telegram, TikTok, or any other third-party platform unless explicitly stated.

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Send spam, unsolicited bulk messages, or deceptive content
• Harass, threaten, defame, or discriminate against others
• Distribute malware, phishing links, or illegal content
• Circumvent platform security, rate limits, or API restrictions
• Impersonate any person or entity without authorization
• Scrape, reverse engineer, or attempt to extract source code from the Service
• Use the Service for any activity that could harm platform users or damage Apus AI's reputation
• Resell or sublicense the Service without our written consent

Automated messaging and comment replies must comply with each platform's rules for bots, commercial messaging, and user consent. You are responsible for configuring automations appropriately and obtaining any required consents from your audience.

The Service may generate automated responses using artificial intelligence based on your configuration. You acknowledge that AI outputs may be inaccurate, incomplete, or inappropriate in some contexts. You are solely responsible for reviewing, approving where necessary, and the consequences of messages sent through your connected accounts.

We do not guarantee that AI-generated content will be error-free, legally compliant, or suitable for every audience. Use human oversight for sensitive, regulated, or high-stakes communications.

Some features require a paid subscription. Pricing, plan limits, and billing cycles are displayed on our website or in your account dashboard. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Free trials, if offered, convert to paid plans at the end of the trial period unless you cancel before the trial expires. Fees are generally non-refundable except where required by law or explicitly stated in a refund policy.

We may change pricing with reasonable notice. Continued use after a price change constitutes acceptance of the new pricing for subsequent billing periods.

The Service, including its software, design, logos, documentation, and branding, is owned by Apus AI and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks without prior written permission.

You retain ownership of content you create or upload. You grant us a limited license to host, process, and display your content solely to provide and improve the Service.

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

The Service relies on third-party platforms, APIs, hosting providers, and payment processors. We are not responsible for the availability, policies, or actions of third parties. Your use of third-party services is governed by their respective terms.

If a third-party platform changes or revokes API access, features dependent on that platform may stop working without liability on our part.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, error-free, or that automation will achieve specific business results, follower growth, or engagement metrics.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APUS AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR ACCOUNT ACCESS, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

You agree to indemnify, defend, and hold harmless Apus AI and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your connected account activity, your content, your violation of these Terms, or your violation of any third-party rights or platform policies.

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms, pose a security risk, or if required by law or a platform partner.

You may cancel your account at any time through the dashboard or by contacting support. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive termination.

Before filing a formal dispute, you agree to contact us at support@socialbot.io and attempt to resolve the issue informally within 30 days.

These Terms are governed by the laws of the Republic of Uzbekistan, without regard to conflict of law principles. Any disputes not resolved informally shall be subject to the exclusive jurisdiction of the courts located in Tashkent, Uzbekistan, unless mandatory consumer protection laws in your country require otherwise.

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Material changes may be communicated by email or in-app notice. Your continued use after changes become effective constitutes acceptance of the revised Terms.
